1. Acceptance of these Terms

These Terms of Service (the "Terms") govern your access to and use of the AruraH website, including <www.arurah.com>, hosted pages, documentation, contact forms, demos, previews, downloads, community spaces, and other services that expressly link to these Terms (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Services. If you are using the Services on behalf of a company, employer, institution, or other legal entity, you represent that you have authority to bind that entity to these Terms, and the words "you" and "your" will refer both to you and that entity as applicable.

These Terms are intended to be public-facing and technology-aware. AruraH may release certain software, model weights, documentation, and related materials publicly under separate licenses. Those releases are addressed specifically below so that rights granted under an applicable open-source license are not accidentally contradicted by general website terms.

2. Eligibility and permitted access

You may use the Services only if you can form a binding agreement under applicable law and your use is not prohibited by any applicable sanctions, trade restrictions, or legal limitations. If you are under the age required to form a binding contract where you live, you may use the Services only with appropriate authorization and supervision, and some features may not be available to minors.

You are responsible for ensuring that your use of the Services complies with all applicable laws, regulations, contractual obligations, internal policies, and industry standards that apply to you. This includes rules relating to privacy, data protection, confidentiality, intellectual property, export controls, consumer protection, employment, accessibility, and AI deployment where relevant.

Access to certain areas of the Services may be limited, invite-only, rate-limited, or subject to additional notices. AruraH may refuse access, impose technical restrictions, or require additional verification where appropriate to protect the Services, users, or the public.

3. Description of the Services

AruraH provides informational pages, contact and collaboration workflows, research materials, documentation, and may provide hosted demonstrations, model previews, download pages, or other AI-related tools. Features may change substantially over time. Some parts of the Services are experimental, incomplete, or subject to revision without notice.

Nothing on the Services should be interpreted as a guarantee that any roadmap item, release, integration, dataset, benchmark, performance claim, or community program will remain available in its current form. Screenshots, documentation examples, benchmark descriptions, architecture summaries, and public statements are provided for general informational purposes unless expressly stated otherwise in a separate written agreement.

AruraH may offer both public and private workflows. Public workflows can include website pages, open documentation, public repositories, and publicly visible issues or discussions. Private workflows can include direct email conversations, pilot discussions, or limited-access evaluations. Different expectations may apply in those environments even when these Terms continue to govern the overall relationship.

4. Separate licenses for open-source and public-release materials

Some materials made available through AruraH may be distributed under a separate open-source, source-available, content, data, documentation, or other public license. Examples can include source code, model weights, prompts, templates, evaluation scripts, datasets, documentation, notebooks, benchmark artifacts, or media assets. When a separate license is attached to a specific artifact, repository, or download, that separate license governs your rights and obligations with respect to that artifact.

These Terms do not supersede, narrow, revoke, or rewrite rights granted to you under an applicable separate license for a released artifact. If there is a direct conflict between these Terms and the specific license accompanying a released artifact, the specific license controls for that artifact to the extent of the conflict.

At the same time, these Terms continue to govern your use of the AruraH website itself, hosted demos, brand assets, private previews, contact forms, community moderation, and any content or service that is not expressly released under a separate license. They also govern conduct in AruraH-operated spaces and the use of AruraH trademarks except where a separate written permission says otherwise.

5. Accounts, invitations, and access credentials

Some features of the Services may require registration, invitations, API keys, access tokens, or other credentials. If AruraH permits or requires an account, you must provide accurate, current information and keep your credentials secure. You may not share credentials in a way that defeats seat limits, security controls, or access restrictions.

You are responsible for activity occurring through your credentials unless the activity results from AruraH's own security failure or another cause for which you are not responsible. You must notify AruraH promptly at info@arurah.com if you suspect unauthorized access, credential compromise, or misuse of an account or token.

AruraH may suspend, rotate, limit, or revoke credentials at any time where reasonably necessary for security, maintenance, legal compliance, abuse prevention, or service integrity.

6. Your responsibilities and information you provide

You are responsible for the content, materials, prompts, files, comments, code, feedback, submissions, and other information you provide through the Services (collectively, "Submissions"). You represent and warrant that you have all rights, permissions, and legal authority necessary to provide your Submissions and to allow AruraH to use them as described in these Terms, the Privacy Policy, any applicable service notice, and any applicable repository workflow.

You must not provide data or material that violates law, infringes intellectual property, breaches confidentiality obligations, invades privacy, contains malicious code, or exposes personal or proprietary information that you are not authorized to share. If you are unsure whether you can share something, do not upload it through a public form, issue tracker, discussion thread, or hosted preview.

Unless AruraH expressly agrees otherwise in writing, you should treat the Services as unsuitable for transmitting payment card information, government identification numbers, health records, special-category personal data, export-controlled technical data, trade secrets, or private guest files. Public issue trackers, repository comments, and open collaboration spaces are especially inappropriate for confidential or regulated data.

7. Acceptable use of the Services

You may use the Services only for lawful, authorized, and responsible purposes. You may not use the Services in a way that interferes with other users, harms AruraH, defeats security measures, violates law, or creates unreasonable risk. The Services are intended to support responsible research, learning, collaboration, and product exploration, not abuse or evasion.

Prohibited conduct includes attempting to gain unauthorized access; interfering with security, rate limits, or monitoring; using the Services to distribute malware, spam, or abusive content; scraping or harvesting data in a manner that imposes unreasonable load or bypasses controls; misrepresenting affiliation; reverse engineering non-public portions of hosted services where prohibited by law; or using the Services in ways that violate privacy, publicity, discrimination, consumer-protection, or intellectual-property rights.

You also may not use AruraH-operated hosted services to support fraud, unlawful surveillance, credential theft, harassment, disinformation operations, or any activity that would reasonably be expected to create material legal, reputational, or safety risk. Where a separate open-source license applies to a released artifact, the scope of your rights in that artifact is determined by that license; however, your conduct on the website and in AruraH-operated hosted services and community spaces remains subject to these Terms.

8. Community contributions, repositories, and collaboration spaces

If AruraH operates public repositories, issue trackers, discussion boards, documentation comment threads, or similar collaboration spaces, your participation may also be governed by repository notices, contribution guidelines, code-of-conduct documents, or platform rules. You are responsible for reading and complying with those materials where they apply.

Unless a repository specifies a different contribution process, you acknowledge that submitting code, documentation, or other material to an AruraH-managed repository may allow AruraH and downstream users to use, reproduce, modify, distribute, and otherwise handle that contribution under the license applicable to the repository or project. If a repository uses a contributor agreement, developer certificate of origin, or similar mechanism, your submission will also be subject to that process.

AruraH is not obligated to accept any contribution, merge any pull request, publish any issue, respond to any suggestion, or maintain any project in a particular way. Maintainers may edit, close, archive, moderate, or decline public submissions for technical, legal, safety, quality, or community reasons.

9. License to use your Submissions

To the extent necessary for AruraH to operate the Services, evaluate requests, provide responses, host public discussions, review contributions, troubleshoot issues, improve documentation, and carry out the legitimate purposes described in our Privacy Policy, you grant AruraH a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify for formatting or technical compatibility, transmit, display, and otherwise use your Submissions.

This license is limited by context. For example, if you email us privately with a support request, the license allows us to read and respond to that request and maintain appropriate records. If you post a public issue or submit a pull request to a repository, the relevant repository license and public collaboration model may allow broader use. If AruraH wishes to use your Submission in a materially different way that requires separate permission, we will seek that permission where appropriate.

You retain ownership of your Submissions except to the extent rights are granted to AruraH, to platform providers, or to the public through a separate repository or content license chosen by you or the applicable project.

10. Feedback

If you provide ideas, suggestions, improvement requests, bug reports, evaluation notes, benchmark comments, or other feedback about the Services or an AruraH release, you agree that AruraH may use that feedback without restriction or compensation, provided that doing so does not override any confidentiality obligation expressly agreed in writing. Feedback helps us improve quality, safety, governance, documentation, and usability.

This section does not require you to give up rights in code or other material that you intentionally contribute under a repository workflow governed by a separate license; instead, it applies primarily to general feedback and suggestions that are not otherwise governed by a specific contribution process.

11. AI outputs, research previews, and human review

AruraH's hosted demos, previews, benchmarks, models, and other AI-related Services may generate outputs that are probabilistic, incomplete, inaccurate, outdated, biased, offensive, or otherwise unsuitable for your intended use. You are solely responsible for evaluating whether any output is appropriate for your use case.

You must not rely on AI outputs from the Services as the sole basis for decisions involving legal rights, employment, credit, housing, insurance, healthcare, public safety, law enforcement, emergency response, education, immigration, critical infrastructure, aviation, or any other high-risk or regulated use case without independent review and any safeguards required by law. AruraH may state intended and non-intended use cases in documentation, model cards, release notes, or other notices, and you are responsible for reading and respecting them.

Hosted previews and public research materials are particularly likely to change, fail, or contain limitations. Even where AruraH describes a model as domain-specialized or safety-aware, that does not mean the model is fit for all operational contexts or that it will perform consistently across environments, languages, cultures, image conditions, or edge cases.

12. Beta features and experimental services

AruraH may label some features as alpha, beta, preview, research, pilot, experimental, or similar. Those features may have defects, reduced security hardening, incomplete documentation, missing support, or changes that would not be acceptable in a generally available commercial service.

By using an experimental feature, you understand and accept the heightened possibility of interruption, incorrect outputs, design changes, and data loss or incompatibility. AruraH may discontinue experimental features at any time and may not maintain backward compatibility.

13. Intellectual property rights

Except for your rights in your own Submissions and any rights granted under a separate open-source or public license, AruraH and its licensors reserve all rights, title, and interest in and to the Services, including the website design, non-public software, hosted interfaces, text, graphics, logos, compilations, documentation, and other content made available through the Services.

Nothing in these Terms transfers ownership of AruraH intellectual property to you. Subject to these Terms, AruraH grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for their intended purpose. This right ends when your access is terminated or when the relevant Service is discontinued.

You may not remove proprietary notices, misrepresent authorship, or falsely imply endorsement, sponsorship, or affiliation. If AruraH publishes brand guidelines or asset usage rules, you must follow them.

14. Trademarks and branding

The names AruraH, associated logos, slogans, and other brand identifiers are trademarks or source identifiers of AruraH or its affiliates, licensors, or contributors. Open-source availability of code or model weights does not, by itself, grant you the right to use AruraH trademarks, logos, trade dress, or project branding in a way that implies endorsement, partnership, certification, or official status.

You may use factual references necessary to describe compatibility, provenance, or origin, so long as your usage is truthful and does not create confusion. Any broader brand use, including co-branding, promotional use, or domain names that are confusingly similar, requires AruraH's prior written permission.

15. Third-party services, links, and dependencies

The Services may link to or integrate with third-party websites, repositories, package managers, APIs, videos, plugins, infrastructure services, or collaboration tools. AruraH does not control third-party services and is not responsible for their content, availability, security, policies, or performance.

Your use of third-party services is governed by the terms and policies of those third parties. This is particularly important in open-source ecosystems, where package registries, repository hosts, hosting providers, or dependency libraries may have their own licenses, notices, or operational risks.

16. Availability, changes, and support

AruraH may modify, suspend, or discontinue any part of the Services at any time. We are not obligated to maintain any feature, page, demo, documentation set, or release cadence, and we may change technical requirements, compatibility assumptions, pricing, access models, or governance procedures without prior notice unless law requires otherwise.

Unless AruraH expressly commits to a support arrangement in a separate written agreement, the Services are provided without any duty of maintenance, support, uptime, or response times. Community or public support channels may be offered as a courtesy and may be moderated, paused, or archived at any time.

17. Fees and future paid services

At the time of publication, some Services may be available without charge. If AruraH later introduces paid services, subscriptions, enterprise plans, or pilot fees, additional commercial terms may apply. AruraH may post or provide those terms separately, and they will supplement these Terms for the relevant paid offering.

Unless otherwise stated, taxes, banking fees, and similar charges relating to a paid service are your responsibility. Failure to pay for a paid service may result in suspension or termination of that service.

18. Suspension and termination

AruraH may suspend or terminate your access to all or part of the Services at any time, with or without notice, if we reasonably believe that you have violated these Terms, created risk, failed to comply with applicable law, interfered with the Services, infringed rights, or used the Services in a way that could harm AruraH, users, contributors, or the public.

You may stop using the Services at any time. Sections that by their nature should survive termination will survive, including sections relating to intellectual property, disclaimers, limitations of liability, indemnity, dispute resolution, feedback, and any licenses reasonably necessary for AruraH to preserve repository history, maintain records, or comply with law.

Termination of your access to the website or hosted service does not revoke rights already granted to you under a separate open-source license covering a specific released artifact, unless that separate license itself allows termination on its own terms.

19. Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. ARURAH DISCLAIMS ALL WARRANTIES, REPRESENTATIONS, AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, RESULTS, OR AVAILABILITY.

Without limiting the foregoing, AruraH does not warrant that the Services will be uninterrupted, secure, error-free, virus-free, up to date, complete, or accurate; that defects will be corrected; that outputs will be reliable or suitable for your intended use; or that the Services will meet any performance, compliance, safety, or compatibility requirement you may have.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you to the extent prohibited by law.

20. Limitation of liability

To the maximum extent permitted by law, AruraH and its founders, team members, contributors, advisors, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, business opportunity, or reputation, arising out of or relating to the Services, even if advised of the possibility of such damages.

To the maximum extent permitted by law, the aggregate liability of AruraH arising out of or relating to the Services or these Terms will not exceed the greater of (a) one hundred Canadian dollars (CAD $100) or (b) the total amount you paid to AruraH for the specific Services giving rise to the claim in the twelve months preceding the event giving rise to liability.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. If applicable law does not allow parts of this section to apply, those parts will apply only to the maximum extent permitted.

21. Indemnification

To the maximum extent permitted by law, you will defend, indemnify, and hold harmless AruraH and its founders, team members, contributors, advisors, affiliates, licensors, and service providers from and against claims, demands, liabilities, damages, judgments, settlements, losses, costs, and expenses, including reasonable legal fees, arising out of or relating to your use of the Services, your Submissions, your violation of these Terms, or your violation of any law or third-party right.

AruraH reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you will cooperate with AruraH in asserting any available defenses.

22. Export controls, sanctions, and restricted uses

You may not use, access, export, re-export, transfer, or make available the Services or any released artifact in violation of applicable export-control, sanctions, anti-boycott, or trade-compliance laws. You represent that you are not located in, organized under the laws of, or ordinarily resident in a country or territory subject to comprehensive sanctions that would prohibit the relevant access, and that you are not on a restricted-party list applicable to the Services.

You are solely responsible for determining whether your use, download, modification, hosting, or distribution of an AruraH release is subject to export, import, licensing, customs, or sector-specific compliance obligations.

23. Governing law and disputes

These Terms and any dispute arising out of or relating to them or the Services will be governed by the laws of the Province of Quebec and the federal laws of Canada applicable there, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Subject to any mandatory rights you may have under applicable consumer or local law, the courts located in Montreal, Quebec will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services, and you and AruraH consent to personal jurisdiction and venue in those courts.

Before starting formal proceedings, the parties agree to attempt in good faith to resolve the dispute informally by contacting the other party with a written summary of the issue. This does not prevent either party from seeking urgent equitable or injunctive relief where necessary to protect rights, confidentiality, security, or intellectual property.

24. Changes to the Terms

AruraH may update these Terms from time to time. When we do, we may update the version date, post the revised Terms on the website, and take other reasonable steps to communicate material changes where appropriate. Changes will become effective on the date specified in the updated Terms unless a different timing is required by law.

By continuing to use the Services after updated Terms become effective, you agree to the revised Terms to the extent permitted by law. If you do not agree to an update, you must stop using the affected Services.

25. General provisions

If any provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect. AruraH's failure to enforce a provision is not a waiver. These Terms, together with any linked policies, supplemental service notices, and applicable separate licenses, form the entire agreement between you and AruraH regarding the Services they cover.

You may not assign or transfer these Terms without AruraH's prior written consent, except where assignment cannot be restricted by law. AruraH may assign these Terms in connection with a merger, financing, reorganization, transfer of assets, or similar transaction. Headings are for convenience only and do not affect interpretation.
